Agreement To These Terms

Affiliate Insiders LLC (“Affiliate Insiders,” “we,” “us,” or “our”) is a Wyoming limited liability company. These Terms of Service (the “Terms”) govern your access to and use of affiliateinsiders.co and any related pages, our email newsletter, our SMS alert program, our community channels, and any other content or service we make available (together, the “Service”).

By visiting the Service, submitting your email address or phone number, joining our community, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Please read Section 18 carefully. It requires most disputes to be resolved by binding individual arbitration and waives your right to participate in a class action.

Who May Use The Service

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is not directed to children, and we do not knowingly collect information from anyone under 18.

By using the Service, you represent that you meet these requirements, that the information you give us is accurate and belongs to you, and that your use of the Service will not violate any law that applies to you.

What Affiliate Insiders Is

Affiliate Insiders is a free editorial newsletter and content resource for people working in affiliate and performance marketing. We publish commentary on offers, traffic sources, ad creative, and campaign strategy, along with case studies and occasional promotional messages.

Everything we publish is information and opinion. It is not a service agreement, a partnership, a joint venture, an employment relationship, or a promise of any particular result. We are not responsible for how you apply anything you read, and we do not manage, operate, or supervise your campaigns, ad accounts, or business.

We may add, change, suspend, or discontinue any part of the Service at any time without notice.

Email Subscription

When you submit your email address, you are asking to receive our newsletter and related messages. These may include editorial content, case studies, product announcements, event invitations, and promotional offers — including offers for which we are paid (see Section 7).

You can unsubscribe at any time using the link at the bottom of any email, or by emailing us at the address in Section 22. We will process opt-out requests promptly. We may still send you non-marketing messages, such as replies to a support request.

You agree not to submit an email address you do not own or control, and not to use disposable or automated addresses to abuse the Service.

SMS & Text Message Program

You confirm that you are the subscriber to, or the customary user of, the mobile number you submit, and that you are authorized to consent to receive texts at that number. If you change or give up the number, you agree to tell us right away.

Delivery is not guaranteed. Message delivery depends on your carrier and on conditions outside our control. Opting out of texts does not remove you from our email list, and unsubscribing from email does not remove you from the SMS program — each is handled separately.

We do not sell, rent, or share your mobile number or your SMS consent with third parties for their own marketing purposes. See our Privacy Policy for details.

Telegram Community

We operate a community channel on Telegram. Telegram is a third-party platform with its own terms and privacy policy, and your use of it is governed by those documents in addition to these Terms.

Inside the community, you agree not to spam, recruit, solicit members privately without permission, post other members' private information, share pirated material, or post anything unlawful or abusive. We may remove content and remove or ban any member at any time, for any reason, without notice.

Anything posted by other members is their own opinion, not ours. We do not vet, endorse, or verify member posts, and we are not responsible for anything you do based on them.

Affiliate Disclosure & Compensation

We are an independent publisher. We are not an agent, employee, partner, or representative of any network, advertiser, or platform we write about, and no coverage should be read as a guarantee, endorsement, or warranty of that third party's product, service, payouts, or business practices.

Do your own due diligence before spending money with anyone we mention.

No Professional Advice

Nothing on the Service is financial, investment, tax, accounting, legal, or business advice, and nothing on the Service creates a professional or fiduciary relationship between you and us.

Advertising, affiliate marketing, and media buying involve real financial risk, including the total loss of the money you spend. You are solely responsible for your own decisions and for complying with every law, regulation, network policy, and advertising platform rule that applies to you — including the FTC Act, the CAN-SPAM Act, the Telephone Consumer Protection Act, and the terms of service of any ad platform or affiliate network you use.

Earnings Disclaimer

We make no guarantee of income, profit, revenue, or results of any kind.

Any figures, screenshots, case studies, testimonials, or examples we publish are exceptional results. They are not typical, they are not average, and they are not a promise or projection that you or anyone else will earn the same, similar, or any amount at all. Past performance of a campaign, offer, or strategy says nothing about its future performance.

Your results depend on your own experience, capital, work ethic, market conditions, offer selection, traffic quality, and many factors outside anyone's control. Most people who attempt affiliate marketing do not become profitable. You accept the entire risk of any action you take based on the Service.

Intellectual Property

The Service and everything in it — text, newsletters, case studies, graphics, logos, the Affiliate Insiders name and marks, page design, code, and the selection and arrangement of all of it — is owned by us or our licensors and is protected by copyright, trademark, and other laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and read the Service for your own internal use. You may quote short excerpts with clear attribution and a link back.

You may not copy, republish, resell, redistribute, syndicate, scrape, mirror, or create derivative works from the Service, or use it to train a machine learning or AI model, without our prior written permission. All rights not expressly granted are reserved.

Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, or deceptive purpose.
• Submit an email address or phone number that is not yours or that you are not authorized to submit.
• Use bots, scrapers, crawlers, or other automated means to access, harvest, or copy the Service or its subscriber data.
• Attempt to gain unauthorized access to the Service, our systems, or any account, or interfere with, overload, or disrupt them.
• Reverse engineer, decompile, or probe any part of the Service.
• Impersonate Affiliate Insiders or suggest an affiliation, sponsorship, or endorsement that does not exist.
• Remove, obscure, or alter any copyright, trademark, or other proprietary notice.

We may investigate and take any action we consider appropriate, including removing content, suspending access, and reporting activity to law enforcement.

Third-Party Offers & Links

The Service links to and discusses third-party websites, affiliate networks, advertisers, software, and offers that we do not own or control.

We provide these references for convenience and information only. We do not control and are not responsible for their content, pricing, payout terms, tracking, availability, privacy practices, or the way they treat you. Any dealing you have with a third party — including any payment, dispute, or chargeback — is strictly between you and that third party.

Once you leave the Service, these Terms no longer govern; the third party's terms do. Read them.

Privacy

Our Privacy Policy explains what we collect, why we collect it, who we share it with, and the choices and rights you have. It is incorporated into these Terms by reference. By using the Service, you consent to the practices it describes.

Disclaimer Of Warranties

The service is provided “as is” and “as available,” with all faults and without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.

We do not warrant that the service will be uninterrupted, secure, timely, or error-free, that any content is accurate, current, or complete, that defects will be corrected, or that the service is free of viruses or other harmful components. No advice or information you get from us, whether oral or written, creates any warranty not expressly stated in these terms.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

Limitation Of Liability

To the fullest extent permitted by law, in no event will Affiliate Insiders, its owners, members, officers, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, ad spend, data, goodwill, or business opportunity, arising out of or related to the service or these terms, whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we were advised of the possibility of such damages.

Our total aggregate liability for all claims relating to the service will not exceed the greater of the total amount you paid us in the twelve months before the event giving rise to the claim, or one hundred U.S. dollars ($100).

These limits apply even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Affiliate Insiders and its owners, members, officers, employees, contractors, and agents from and against any claim, demand, action, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms or of any law, your infringement of anyone's rights, or any content or information you submit.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate with our defense.

Termination

We may suspend or terminate your access to the Service, remove you from our lists, or remove you from our community at any time, for any reason or no reason, with or without notice.

You may stop using the Service at any time by unsubscribing from email, replying STOP to texts, and leaving our community channels.

Sections 7 through 22 survive any termination.

Dispute Resolution & Arbitration

Informal Resolution First

Before starting any formal proceeding, you agree to contact us at the address in Section 22 and give us 30 days to try to resolve the dispute informally. Most issues can be handled this way.

Binding Individual Arbitration

If we cannot resolve it, you and we agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in Sheridan County, Wyoming, or by video or telephone at your election, and the arbitrator's decision may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver

You and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding.

Exceptions & Opt-Out

Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property rights.

You may opt out of this arbitration agreement by emailing us at the address in Section 22 within 30 days of first accepting these Terms, with your name, the email address you used, and a clear statement that you are opting out of arbitration. Opting out will not affect any other part of these Terms.

If the class action waiver is found unenforceable as to a particular claim, that claim will proceed in court and the rest of this section will still apply.

Governing Law

These Terms and any dispute arising from them are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules. For any matter not subject to arbitration, you and we consent to the exclusive jurisdiction and venue of the state and federal courts located in Wyoming.

Changes To These Terms

We may update these Terms at any time. When we do, we will change the “Last updated” date at the top of this page. If the changes are material, we will make a reasonable effort to notify you — for example, by email or by a notice on the Service.

Your continued use of the Service after the changes take effect means you accept the revised Terms. If you do not accept them, stop using the Service and unsubscribe.

Miscellaneous

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service and replace any prior agreement or understanding on the subject.

Severability. If any provision is held invalid or unenforceable, it will be limited or removed to the minimum extent necessary, and the rest will remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment. You may not assign or transfer these Terms without our written consent. We may assign them freely, including in connection with a merger, acquisition, or sale of assets.

Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control.

Headings. Section headings are for convenience only and do not affect interpretation.
